The statute providing that, if at any time after the evidence on either side is closed, the court deems it insufficient to warrant conviction, it may advise the jury to acquit, is applicable only where court deems evidence, although tending to prove every element necessary to constitution crime charged, insufficient in weight to warrant a conviction. 2. Larceny ? Amount of money immaterial. Under statute making it grand larceny to take property from person of another with felonious intent, it is immaterial what amount of money may have been taken. - Page 331
